By accessing or using JobPeak.io, you agree to be bound by these Terms & Conditions. JobPeak.io is operated by Digital Marketing Gen, Inc. d/b/a Audience Target ("we," "us," or "our"). If you do not agree to these Terms, please do not use this platform.

2. About JobPeak.io
JobPeak.io is a programmatic job aggregation and distribution platform specializing in CDL driver and transportation industry employment. The platform distributes job listings to career site partners, processes inbound driver leads from digital advertising campaigns, and routes interested applicants to carrier-specific application funnels. JobPeak.io is part of the Digital Marketing Gen, Inc. ecosystem which also includes audiencetarget.ai and appfunnels.io.
3. Eligibility
To use this platform you must be at least 18 years of age, provide accurate and complete information, and agree to comply with all applicable laws including labor and employment regulations.
4. Use of the Platform
4.1 Acceptable Use
You agree to use JobPeak.io only for lawful purposes related to employment seeking or recruiting. You agree to provide accurate information and to comply with all applicable federal, state, and local laws.
4.2 Prohibited Activities
You may not use this platform to engage in any fraudulent or illegal activity, submit false or misleading information, attempt to gain unauthorized access to platform systems, distribute harmful or malicious content, or engage in harassment or discrimination of any kind.
5. Job Listings and Applications
Job opportunities on JobPeak.io are provided by third-party carriers and employers. We do not guarantee the accuracy, availability, or validity of any job listing. Submission of an application does not guarantee any specific employment outcome. We are not responsible for any hiring decisions made by carriers or employers using this platform.
6. Privacy and Data Collection
All personal data submitted through this platform is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using this platform you consent to the collection and use of your data as described in our Privacy Policy.

7. SMS Terms & Conditions
7.1 Business Identity & SMS Use Cases
Digital Marketing Gen, Inc. d/b/a Audience Target operates JobPeak.io and uses SMS messaging to communicate with opted-in contacts. Messages may include job opportunity notifications, application status updates, interview scheduling confirmations, recruiter follow-up, and document reminders related to CDL driver recruiting.
7.2 Opt-Out & Support Mechanisms
You can cancel the SMS service at any time. Just text "STOP" to +1 (516) 604-7332. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

7.3 Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages as needed throughout your job search or application process. Message frequency varies based on your activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
7.4 Carrier Liability
Carriers are not liable for delayed or undelivered messages.
7.5 Age Restriction
SMS communications are intended for individuals 18 years of age or older.
7.6 SMS Non-Sharing
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8. Intellectual Property
All content, design, software, and materials on JobPeak.io are the property of Digital Marketing Gen, Inc. and are protected by applicable intellectual property laws. No content may be reproduced, distributed, or used commercially without prior written consent.
9. Termination of Access
We reserve the right to suspend or terminate your access to the platform at any time if you violate these Terms or if we determine your actions are harmful to other users or the integrity of the platform.
10. Limitation of Liability
The platform is provided "as is" without warranties of any kind. We do not guarantee that the platform will be error-free or uninterrupted, or that job opportunities will be available at all times. To the maximum extent permitted by law, Digital Marketing Gen, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this platform.
11. Indemnification
You agree to indemnify and hold harmless Digital Marketing Gen, Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the platform or violation of these Terms.
12. Changes to Terms
We may modify these Terms at any time. You will be notified of significant changes through the platform. Continued use after any changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York. Any disputes arising under these Terms will be resolved in the appropriate courts of Nassau County, New York.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
